General Terms and Conditions

ARTICLE 1: IDENTITY OF THE ENTREPRENEUR 

These terms and conditions apply to all agreements and services offered by:

ARTICLE 2: APPLICABILITY 

2.1. These general terms and conditions apply to any offer from the entrepreneur and to any agreement (appointment or purchase) made between the entrepreneur and the customer.
2.2. By booking an appointment or making a purchase (via the website, email, social media, or in the studio), the customer agrees to these terms.
2.3. For tattoo appointments, the customer must be at least 18 years old. Identification may be requested at any time.

ARTICLE 3: APPOINTMENTS AND DEPOSITS (TATTOO) 

3.1. An appointment is only final after confirmation by Gennaro De Schrijver and receipt of the required deposit.
3.2. The amount of the deposit depends on the duration of the session:

  • Appointments < 2 hours: € 50.00

  • Appointments 2 - 4 hours: € 100.00

  • Appointments > 4 hours: € 150.00

  • Multi-day sessions: € 150.00 per day

3.3. The remaining amount must be paid immediately after the session. We accept cash, Payconiq/Wero, or BTC.
3.4. The starting price for a tattoo is € 200.

ARTICLE 4: CANCELLATION AND RESCHEDULING (SERVICES) 

4.1. Rescheduling: The customer can reschedule the appointment to a new date free of charge, provided this is communicated at least 2 days before the scheduled appointment. The deposit will remain in that case.
4.2. Late cancellation: In case of cancellation or rescheduling less than 2 days in advance, the deposit will be forfeited. No refund will be granted.
4.3. No-show: If the client does not show up without notice ("no-show"), the deposit is completely forfeited. The studio reserves the right to place the client on a "blacklist" for future appointments.
4.4. Late arrival: If the client is more than 15 minutes late, the appointment may be canceled if there is insufficient time remaining. This is considered a cancellation in which the deposit is forfeited.
4.5. If the studio must cancel the appointment due to force majeure, the client will be notified at least 2 days in advance and a new date will be sought or compensation offered.

ARTICLE 5: DESIGN AND INTELLECTUAL PROPERTY

 5.1 All designs, drawings, and sketches made by Gennaro De Schrijver remain the intellectual property of the artist. The client is not allowed to take designs to other artists or use them for commercial purposes without written permission.
5.2. Use of Media: The client gives permission for the creation of photo and video material of both the process (during the session) and the final result.  Additionally, testimonials (reviews, written feedback, video interviews) may be used for promotional purposes on the website and social media.
5.3. Privacy: If the client does not want to be recognizable (e.g., with face) in the image or wants a testimonial to be posted anonymously, this must be reported prior to the session or interview. We respect the client's privacy wishes at all times.
5.4. The client is responsible for checking the design (spelling, dates, details) before the tattooing begins. Errors discovered after the tattooing are the client's responsibility.

ARTICLE 6: HEALTH AND SAFETY 

6.1. The client declares to be healthy and not to have any medical conditions that adversely affect the tattooing or healing, unless this has been discussed and approved in advance (possibly with a doctor's certificate).
6.2. Gennaro De Schrijver does not tattoo when the client is:

  • Pregnant or breastfeeding.

  • Influenced by alcohol or drugs.

  • Using of blood thinners (without medical consultation).

  • Has skin problems at the tattoo site (e.g., eczema, acne, keloids, sunburn).

  • Using of numbing cream (Emla, etc.) without permission. If detected, the session may be refused, and the deposit will be fully withheld.

ARTICLE 7: LIABILITY AND AFTERCARE 

7.1. Getting a tattoo is at your own risk. Gennaro De Schrijver is not liable for allergic reactions, infections, or undesirable healing results that arise from not following the aftercare instructions.
7.2. The customer receives detailed aftercare instructions and is responsible for correctly following them.
7.3.Touch-ups: The first touch-up is included in the price,unlessthe tattoo is located on the hands, fingers, wrists, or feet. Touch-ups for these areas are chargeable.
7.4. The studio is not liable for stains on clothing or footwear that occur during the session.

ARTICLE 8: RIGHT OF WITHDRAWAL (ONLINE BOOKINGS) 

8.1. Legally, consumers often have a 14-day reflection period for online purchases. However, for services related to leisure activities where a specific date or period has been agreed upon (such as a tattoo appointment), the right of withdrawal is excluded.. 
8.2. This means that a booking made is binding and can only be canceled according to the rules in Article 4.

ARTICLE 10: GIFT VOUCHERS 

9.1. Gift vouchers issued by Gennaro De Schrijver are valid for 1 year from the date of issue, unless otherwise stated in writing on the voucher. After the expiration date, the voucher can no longer be used.
9.2. Gift vouchers are strictly personal (unless otherwise agreed) and are not redeemable for cash. They cannot be returned.
9.3. The studio is not responsible for loss, theft, or damage to the gift voucher. Lost vouchers will not be replaced.
9.4. If the price of the service is lower than the value of the gift voucher, the remaining amount will remain as credit for a future session. No change will be given in cash.

ARTICLE 11: 1-ON-1 COACHING 

10.1. Obligation to make an effort: Gennaro De Schrijver performs the coaching services to the best of their insight and ability. However, this is an obligation to make an effort and not an obligation to achieve results. Gennaro De Schrijver  does not guarantee specific results, as these also depend on the effort and implementation by the client.
10.2. Liability: Gennaro De Schrijver is not liable for any direct or indirect damage resulting from the application of the advice by the client. The client remains responsible for their choices and decisions at all times.
10.3. Cancellation: The same cancellation conditions apply to coaching sessions as stated in Article 4 (cancellation at least 2 days in advance).
10.4. Confidentiality: Both parties are obliged to maintain confidentiality about everything discussed during the coaching, unless a legal obligation prescribes otherwise.

ARTICLE 12: ONLINE PRODUCTS (E-BOOKS / COURSES) 


11.1. Delivery: After receipt of payment, digital products (such as e-books, presets, or online courses) will be delivered immediately via email or a download link.
11.2. No Right of Withdrawal: When purchasing digital content that is not delivered on a physical medium (downloads/streaming), the client waives their right of withdrawal as soon as the delivery (download or access) has started. This means that purchases of digital products are final and will not be refunded.
11.3. Intellectual Property: The customer is not allowed to copy, distribute, publicly disclose, or resell purchased digital products, course materials, or e-books to third parties. The product is solely for the personal use of the buyer.

ARTICLE 9: COMPLAINTS AND DISPUTES 

12.1. In case of complaints, the customer must first contact the entrepreneur to work together towards a solution.
12.2. Only the Belgian law applies to all agreements.
12.3. Disputes that cannot be resolved mutually will be submitted to the competent courts of the judicial district of East Flanders (Ghent division).

ARTICLE 13: PRIVACY AND PERSONAL DATA 

13.1. Gennaro De Schrijver attaches great importance to the privacy of the client. Personal data is processed in accordance with applicable legislation (GDPR).
